Judge Issues Temp Order Amid Abortion Lawsuit

(POCATELLO) – A federal judge has filed a temporary restraining order to prevent a Bannock County prosecutor from filing a lawsuit. Last Friday, U.S. District Judge B. Lynn Winmill issued a 14-day restraining order against prosecutor Mark Heideman,  who could eventually refile charges against Jennie Linn McCormack. McCormack was charged with a felony in May after allegedly receiving an illegal abortion last December. Those charges were later dropped without prejudice. McCormack is currently suing Heideman in federal court, challenging the constitutionality of Idaho’s so-called “fetal pain law.”
