The female’s former employer had filed an appeal against the initial judgement in favor of the victim, saying her romp was her own business and the injury from a falling lamp during the deed wasn’t their responsibility.

However, the court weighed in on the five-year legal battle last week, according to the Courier Mail, determining that because the company picked the motel in which she was injured, the victim’s employers were responsible for whatever occurred there during the trip.

Because she was “engaged in sexual activity rather than some other lawful recreational activity while in her hotel room does not lead to any different result,” the court decided.

Her employer has just one legal card left to play before it must pay up: an appeal to Australia’s High Court.
