According to multiple reports, including one posted on TMZ.com, the Mean Girls star initially claimed that she would be unable to make a mandatory appearance in a Los Angeles court for a pre-trial hearing because she is ill.

TMZ reported her lawyer had submitted to the court a note from a New York City doctor who said Lohan is suffering from an upper respiratory infection and thus could not fly across the country for the hearing.  However, TMZ also posted pictures of Lohan smoking a cigarette while shopping in the Big Apple on Saturday, implying that her condition had been exaggerated.

TMZ later reported that Lohan apparently had a change of heart and had booked a flight to Los Angeles for Tuesday night.

If Lohan for some reason doesn’t show up to court on Wednesday, it could spell trouble for her.

ABC News legal analyst Royal Oakes says, “Unless the judge is absolutely convinced that her excuse is legitimate, the judge could well issue a bench warrant and order her to immediately go to jail.”

The hearing is related to the misdemeanor charges Lohan faces in connection with her car crash on the Pacific Coast Highway last June.  She’s pleaded not guilty to lying to police, driving recklessly, and obstructing an officer from doing his duties.

Lohan was on probation at the time of the accident for a 2011 necklace theft case.  Her probation was revoked last month as a result of the charges stemming from her accident.  She could face 245 days in jail if it’s determined she violated her probation.

In New York, another case involving Lohan’s alleged physical altercation with a psychic at a nightclub last November is still pending.
