Partial Ruling Says JCPenny Can Sell Martha Stewart Goods
Published at(NEW YORK) — Macy’s and JCPenny are still battling over the right to sell Martha Stewart products, but a judge in New York City gave a partial ruling Friday allowing JCPenny to sell some of Stewart’s home goods.
The battle started over Macy’s objection of Macy’s to JCPenny selling Martha Stewart products, as the company says it has the exclusive rights on her sheets, towels and cookware.
The items covered by Friday’s ruling do not carry Stewart’s name, but were designed for JCPenny by her company. Macy’s had wanted the judge to ban its rival from selling anything connected to Martha Stewart and plans to appeal.
The ruling frees up about $100 million worth of merchandise JCPenny had sitting in storage.
