Nebraska Man Sues Wal-Mart for Wife’s Death

157019316?  SQUARESPACE CACHEVERSION=1377793491320FREDERIC J. BROWN/AFP/Getty Image(PLATTSMOUTH, Neb.) — A Nebraska man has sued Wal-Mart and the company’s plastic bag maker, claiming a poorly-trained clerk gave his wife a heavy bag, which broke and eventually led to her death.

William Fries said his wife, Lynette, went grocery shopping at Wal-Mart in April 2010, where the cashier put her two 42-ounce La Choy cans and two-pound rice bag into a single plastic bag.

The bag broke as she carried it to the car, and one of the cans fell on her foot, cutting it and breaking her big toe. The accident led to an infection despite antibiotics and surgery, the lawsuit explains, and the spreading infection eventually lead to Lynette’s death in March 2011.

Freis sued Wal-Mart for wrongful death, and also sued bag distributor Bunzl Distribution and manufacturer Hilex Poly Co., according to the Lincoln Journal Star.

The case was transferred to U.S. District Court in Omaha. He is seeking more than $656,000 in medical expenses in addition to other costs.

A Wal-Mart spokesperson extended condolences to the Freis family, but the company has not filed an answer to the allegations.
