(SANTA CLARA, Calif.) — San Francisco 49ers linebacker Aldon Smith was charged with three felony counts of illegal possession of an assault weapon on Wednesday. He’s accused of being intoxicated and firing a gun into the air while trying to end a party at his house in June 2012.
The 24-year-old Smith is currently on an indefinite leave of absence from the 49ers while undergoing treatment for substance abuse following a DUI arrest in September. The district attorney’s office in Santa Clara County expects Smith to turn himself in later this month.
If convicted of the charges, Smith could face up to four years and four months in jail.
