Jahi McMath, 13, was declared brain dead following a surgery to remove her tonsils and adenoids on Dec. 9.

Children’s Hospital Oakland wanted to remove her from life support, but family spokesman Omari Sealy asserts the girl is not dead.

“Jahi is moving when her mother speaks and her mother touches her,” Sealy said.

The family is suing to force the hospital to release Jahi so they can move her via ambulance to a facility in New York, that her family says will continue life support.

According to KGO, the hospital says it will turn off Jahi’s life support at 5 p.m. on Jan. 7, unless a judge issues another order.
