Utah Same-Sex Marriages Can Continue; Narrow Ruling in Ohio

Getty 122313 SameSexMarriage?  SQUARESPACE CACHEVERSION=1387831769650iStock/Thinkstock(WASHINGTON) — A federal judge ruled Monday that same-sex marriages in Utah can continue, denying a request by the state that sought to halt them until the appeals process plays out.

Utah Gov. Gary Herbert called the ruling “disappointing,” but “not surprising.”

Also Monday, a federal judge in Ohio issued an opinion that seems to gut that state’s ban on same-sex marriage. In a narrow decision, affecting couples legally wed in other states, the ruling won’t allow same-sex couples to get married in Ohio, but U.S. District Judge Timothy Black said the state can’t ban same-sex marriage simply because voters didn’t like it in 2004.

In this case, involving two widowers’ attempts to be listed on their late partners’ death certificates, Black writes, “once you get married lawfully in one state, another state cannot summarily take your marriage away.”
