(IDAHO FALLS, ID) – The city of Idaho Falls has lost an appeal over eminent domain on the North Loop Transmission Project. Officials wanted property outside the city limits to be condemned to construct transmission lines. A lower court ruled in favor of the property owners, and the 9th Circuit Court of Appeals upheld the lower court’s ruling. Byron Reed of the Alliance for Property Rights says the city will also have to reimburse the property owners’ legal fees out of the city’s general fund.
