Michael Whiteley has spent 23 years behind bars for a crime he did not commit. Michael was convicted of kidnapping  and raping  his ex-wife. There was no physical evidence and his ex-wife  plead the 5th 69 times when questioned during her testimony. Before his death, Judge Brent Moss ordered a new trial saying he was left with an uneasy feeling that justice was not served. The Supreme Court, however overturned that decision. Judge Marv Smith sentenced Whiteley to 12 years to life after Michael turned down a plea deal that would have had him serve only 4 months. He refused that deal because he would not confess to something he maintains to this day he did not do.
