SALT LAKE CITY (AP) – A Utah man is suing his daughter’s school district because the girl didn’t make the basketball team.

Rick Westmoreland says in a filed lawsuit last week that his daughter wasn’t passed over for the Bonneville High School team because she was a bad player, but because she’s a ninth-grader at South Ogden Junior High.

The district only allows two freshmen from each junior high to play on the high school team. Westmoreland says his daughter was the coaches’ third choice. He calls the policy arbitrary and unconstitutional.

The school district maintains it’s legal and allows ninth-graders to play on high school teams while preserving the junior high sports programs.

Weber School District spokesman Nate Taggart tells The Salt Lake Tribune school officials want the suit to be dismissed.
