SALT LAKE CITY (AP) – Four snowboarders challenging one of the last U.S. ski resorts to prohibit their sport are appealing a recent ruling from a federal judge that upheld the ban.

Attorneys for the snowboarders filed a notice Friday of their intent to challenge the ruling with the 10th U.S. Circuit Court of Appeals in Denver.

U.S. District Judge Dee Benson ruled in favor of Alta ski area in September, saying snowboarders don’t have a constitutional right to practice their sport at the private resort.

The snowboarders filed the lawsuit in January claiming discrimination on national forest lands that make up most of the Alta in the mountains east of Salt Lake City.

The two other resorts that ban snowboarding are Deer Valley, also in Utah, and Mad River Glen in Vermont.
