The August: Osage County actress, 32, was found dead in a Seattle suburb on Oct. 16, but the source of her fatal injuries are still unclear. Her family had reported the actress missing and suicidal a week before her death.

“We’re devastated by this news that we got from the medical examiner’s report,” her father, Charles Upham, told People magazine.

“I said from the beginning that I do not think she committed suicide. I think Misty either fell down and got hurt and couldn’t get up because she was hiding from the police or she came to some harm by people she didn’t know,” he said.

Auburn Police Cmdr. Steve Stocker told the magazine, “At this point, we do not have any information to show foul play” and that he believes she died from the fall.

“We have to go by the medical examiner’s report, which said the manner of her death is undermined. We just don’t know,” Stocker added.

But Charles Upham claims he got a call from a family friend, who said Misty may have been killed.

He said Misty attended a house party and “got into an argument” with two men, who he thinks are involved in her death.

“The cousin of this girl who contacted our friend said they are afraid to talk to the police. They are afraid to come forward,” Charles Upham told People.

But he also said the medical examiner said there was no evidence his daughter was beaten.

“I’m hoping it’s just a story or a rumor but if there is something that needs to be investigated, we want answers and we want justice for our daughter. We are leaving no stone unturned,” he said. “I’m just grasping at straws at this point.”

He continued, “We’re taking everything day by day. We’re not doing well right now. Words cannot describe the pain. We miss her every day.”
