Department of Justice Seeks Stay on Immigration Action Block
Published at(WASHINGTON) — The Justice Department Monday asked for a stay of a federal judge’s order that blocked President Obama’s executive action on immigration reform.
Attorneys for the Justice Department maintained Texas Judge Andrew Hanen’s ruling will cause “irreparable harm” to national security.
In issuing the preliminary injunction, Hanen said that the White House failed to allow public comment on the action that would allow as many as five million undocumented immigrants to apply for legal status.
It’s doubtful whether the request for an emergency court ruling will affect the injunction, meaning the administration will next have to make an appeal before the Fifth Circuit Court in New Orleans, one of the most conservative benches in the country.
Should the appeals court uphold Hanen’s order, the case will likely go to the U.S. Supreme Court, which will essentially rule if Obama overstepped his legal authority to unilaterally issue such broad-based immigration reform.
