Fox Sues to Keep “Empire” Title

SQUARESPACE CACHEVERSION=1427289288893Chuck Hodes/FOX(NEW YORK) — Fox is suing a record label that has claimed it owns the rights to “Empire” as well as a couple of phrases that include that word, according to The Hollywood Reporter. The network, of course, is the home of a popular hip-hop drama of the same name.

The lawsuit targets Empire Distribution, which Fox says has sent letters demanding as much as eight million dollars for what it claims is potential trademark infringement.

Fox is arguing, among other things, that Empire Distribution never applied for a federal trademark registration for “Empire,” and that an application for a similar term from the label is still pending.

The network seeks a declaration from a judge to allow it to continue to use the title Empire for its hit series.

A Fox attorney says, “Fox has no intention of allowing anyone to leverage Empire’s success for their own unwarranted financial gain.”

The first season of Empire concluded last week. The show has been renewed for a second season.
