Iona man arrested inside Applebee’s for aggravated assault
Published at | Updated atIDAHO FALLS — Idaho Falls Police arrested Richard Hays, 77, for two counts of aggravated assault Friday.
The Iona man was also charged with driving under the influence and carrying a concealed weapon while intoxicated.
Bonneville County Jail officials confirmed Hays was booked into the jail at approximately 12 a.m. Friday.
According to reports, officers responded to the 600 block of North Utah Avenue around 9:30 p.m. for a report of a drunk driver.
Officers were advised the drunk driver threatened the reporting parties with a gun, according to an police news release.
The victims told police they had just left a restaurant when they saw Hays driving erratically. They called police and followed Hays to Applebee’s, where they observed him driving erratically and almost hitting parked cars, before he parked his vehicle and threatened them with a gun, according to the news release.
Police located and arrested Hays inside of Applebee’s, at 635 N. Utah Ave.
Hays was previously charged a DUI in 2003, according to the Idaho Repository.
Hays’ most recent charge for driving under the influence would have been considered a felony had his previous DUI charge occurred within the last 10 years, said Joelyn Hansen, Public Information Officer for the Idaho Police Department.
Hays is being held on a $50,800 bond. His arraignment is scheduled for Aug. 3.
