REXBURG – An Upper Valley man is facing criminal charges after police say he shot his two children with an air soft gun.

Kurtis R. Moyer, 29, told the Rexburg Police Department he fired an air soft gun at his 8-year-old and 9-year-old children, because they were misbehaving and being “unruly.” He also is accused of pushing both children.

“He shot the kids as a form of punishment and discipline,” Capt. Randy Lewis says. “The children had welts on their body, but are doing okay.”

The alleged incident happened on Tuesday, Sept. 22, according to police reports. Moyer turned himself into authorities and was arrested Tuesday, Sept. 29. He is facing two misdemeanor counts of injury to a child and assault. Police say the children are now in custody of a relative.

He posted $20,000 bond this week and was released from jail.

In 2011, Moyer was charged with domestic battery in the presence of a child, but the court amended the charge to disturbing the peace and Moyer plead guilty.

He also was found guilty of misdemeanor domestic violence in 2005.
