Prosecutor dismisses charges against man accused of child abuse

REXBURG — The City of Rexburg Prosecuting Attorney’s Office dismissed two charges against Upper Valley native Kurtis Moyer on Tuesday, Jan. 19, citing a lack of evidence in the case.

Moyer had been charged with one count misdemeanor injury to a child and one misdemeanor count of assault for alleged incidents regarding his 8-year-old and 9-year-old children.

Deputy City Prosecutor Rob Wood affirmed there was sufficient probable cause to charge Moyer with the crimes, but Wood told EastIdahoNews.com he didn’t feel there was enough evidence to take the case to a jury trial.

In September, Rexburg Police told EastIdahoNews.com the arrest stemmed from an alleged incident where Moyer fired an air soft gun at the children, because they were misbehaving. Police reports detail the alleged incident and include photos of welts caused by the air soft gun.

However, Wood told EastIdahoNews.com on Thursday, Jan 21, the charges against Moyer did not stem from that incident. Rather, the charges were the result of separate incidents where Moyer is alleged to have pushed a child into a wall, and where he purportedly pointed a BB Gun at a child’s head and threatened to fire. Both alleged incidents also are detailed in police reports.

Moyer was arrested in late September and released after posting a $20,000 bond.
