Second kidnapping suspect gets 25 year sentence

IDAHO FALLS — Alvaro Oseguera will spend at least 10 years in prison for the kidnapping of Brandon Bykonen.

On Tuesday, District Judge Bruce Pickett sentenced Oseguera to 25 years in prison with a fixed term of 10 years and 15 years indeterminant. It was the maximum sentence allowed by law.

“This was twisted thinking of paranoia and a methamphetamine haze, I don’t even know how one comes up with such a plan,” Pickett told the court.

Pickett said he considered several factors in the sentencing, including Oseguera’s extensive felonious history.

Oseguera’s defense attorney Neal Randall recommended a fixed sentence of three years, relying on the fact that his client had limited physical involvement as far as the physical aspect in the kidnapping. Randall also noted his client needs alcohol and drug treatment.

Deputy Prosecuting Attorney Tanner Crowther countered with Oseguera’s repeated violent history of going to prison and being released and returning on more violent crimes. Crowther referred to Oseguera as “Tito”, saying it was his street name.

“On his own account he spend 12 years in prison in the state of California, he was a drug dealer, he admitted that he sold heroin, meth, and marijuana,” Crowther said.

The prosecutor recommended a fixed term of ten years with 15 years to follow.

Oseguera will be available for parole in 2025. Should he be released at that time, Oseguera will serve 15 years on supervision.

“I think any lighter sentenced based on your behavior would not be appropriate in this matter,” Pickett said. “I do think that if you’re released from prison you should be monitored for the length of time this court has jurisdiction over you.”
