Restaurant manager gets rider after pleading guilty to raping teenage employee

REXBURG – A 25-year-old man who pleaded guilty to raping an underage employee was sentenced to 15 years in prison on Monday.

District Judge Gregory Moeller sentenced Jose Isaac Turcios Jr. to 2.5 years fixed with the remaining 12.5 years indeterminate. However, Moeller suspended the prison sentence and placed Turcios on a one-year rider sex offender treatment program within the Idaho Department of Correction. Court records show this is Turcios’ first felony offense in Idaho.

After completing the rider, Turcios will return to court for further consideration of his sentence. If he is placed on probation, he will have to register as a sex offender. If he does not complete the rider, he will have to serve his prison sentence.

The Upper Valley man was arrested in mid-November as part of a joint investigation between the Rexburg Police Department and the Madison County Sheriff’s Office.

Investigators say Turcios worked in a supervisory role at a Rexburg fast food restaurant. The 16-year-old female victim was an employee at the restaurant. Police reports show Turcios and the teenager engaged in several sexual acts inside the restaurant in September 2015.

Turcios was originally charged with two felony counts of rape and one felony count of sexual battery of a child. But in February, Madison County Prosecutor Sid Brown told EastIdahoNews.com that as a part of the plea deal, one rape charge and the sexual battery charge would be be dismissed.

Turcios had remained in Madison County Jail since his arrest in November on a $200,000 bond.

CORRECTION: A previous version of this article said Turcios would automatically be placed on probation after he completes his rider. That statement was incorrect and has been changed. EastIdahoNews.com apologizes for the error.
