Lawsuit against Rexburg after baby burned is resolved

The following is a joint press release from the city of Rexburg and Michael and Jenise Porter emailed to the media on Friday. It concerns the lawsuit filed against the city and paramedics after a newborn baby was severely burned while being taken to the hospital in an ambulance. REXBURG — On Oct. 27, 2016, the parties involved in the Porter vs. City of Rexburg and Madison Fire Department case met and were able to resolve the matter through mediation.

Representatives of the Madison Fire Department and the city of Rexburg expressed deep regret at the untold number of hours the Porters had to spend resolving the injury to their daughter.

The Madison Fire Department and the Porter family are pleased to announce that in order to prevent such injury occurring in the future, a new “Londyn Porter policy” in regard to heat packs will be implemented.

The policy will require that all fire department personnel be trained in the use of heat packs and use them in accordance with manufacturer’s specifications to ensure safe application and zero injury.

According to the joint news release the Porters acknowledge that all actions taken by Madison Fire Department personnel in behalf of Londyn were done in good faith to render assistance in an emergency circumstance.

No details of the settlement were released.
