Former probation officer pleads guilty to DUI, reckless driving

REXBURG — A former probation officer pleaded guilty to two charges after being found unconscious behind the wheel twice in just a few weeks.

Benjamin Harris, 37, now faces two years of supervised probation after pleading guilty to a misdemeanor charge of driving under the influence and a misdemeanor charge of reckless driving.

The reckless driving charge was amended from a second DUI as part of a plea agreement. That DUI stems from Harris’s latest arrest when deputies found him on a Rexburg Highway 20 exit passed out in the drivers seat of his car at a stop sign.

The DUI Harris pleaded guilty to Wednesday in Madison County was the result of an arrest in August. In that case, court records show police received information that Harris was likely driving under the influence of prescription drugs.

Deputies located Harris and discovered him unconscious behind the wheel. An ambulance was called and he was taken to Madison Memorial Hospital. A doctor told police that considering the drugs in his system and the circumstances he was found in, Harris was lucky to be alive.

Harris was ordered to pay $410.00 in fines.
