Katie Holmes: Marriage to Tom Cruise Was ‘Irretrievably’ Broken in 2011

SQUARESPACE CACHEVERSION=1341306523588George Pimentel/Getty Images for Creative Artists Agency(NEW YORK) — Katie Holmes claims her marriage to Tom Cruise was “irretrievably” broken at least six months before she filed for divorce in New York, according to legal documents that were obtained by TMZ.  However, sources told TMZ that Cruise was “blindsided” and had “no idea” she was going to file for divorce.

Holmes also claims in her divorce documents that both she and Cruise have resided in New York for “at least 2 years.”

Holmes, who filed her papers in New York City, needs to establish legal residency in the state in order for the New York court to have jurisdiction.  The actress wants the case heard in New York because the New York courts reportedly are more likely to grant her sole custody of the couple’s 6-year-old daughter, Suri.

It’s likely that Cruise, who also shared a home with Holmes in Beverly Hills for several years, will dispute the residency claim.

In related news, TMZ reports that Holmes has canned her old security team, comprised of a bodyguard and a driver, because they were assigned to her by Cruise years ago, and had been employed by Cruise for many years before that.  The last time Holmes was spotted out with her old security team was last Tuesday.  It’s not known if the duo are Scientologists.

Holmes spent six hours filming an episode of Lifetime’s Project Runway: All Stars on Monday in New York, according to The Hollywood Reporter.  She is set to be a guest judge on the fashion and design series. She was spotted without her wedding ring while leaving the taping.

Project Runway‘s tenth season debuts Thursday, July 19, on Lifetime, but an air date for its upcoming All-Stars edition has not yet been announced.
