Lindsay Lohan Won’t Face Charges in NYC Nightclub Altercation

E 111612 LindsayLohanGMAJPG?  SQUARESPACE CACHEVERSION=1363988785973ABC News(NEW YORK) — Lindsay Lohan will not face criminal charges in New York City stemming from an alleged nightclub altercation last November.

It’s a rare bit of good legal news for the troubled actress, who earlier this month agreed to three months in mandatory rehab as part of a deal with prosecutors in Los Angeles. There, she faced charges that she lied to police about whether she was behind the wheel in a June car crash that sent her to the hospital briefly.

The New York City case involved an alleged altercation between Lohan and a woman named Tiffany Mitchell at Club Avenue in Manhattan.

A law enforcement source tells ABC News that nightclub video which purported to show the altercation was inconclusive.  The source adds that despite a thorough investigation, there were not enough eyewitness accounts to bring a case.  Furthermore, the source says, Mitchell fell outside the club as she was being escorted out by police, and the fall may have been the source of her injuries, not the alleged altercation.

The Manhattan District Attorney’s office declined to comment on the case.

In a statement, Mitchell’s lawyer, Gloria Allred, left the door open to a potential civil suit against Lohan, saying, “Ms. Mitchell is considering all of her legal options in the civil justice system because of what she suffered that night.”
