Court Slams Woman Seeking Workers’ Comp for Business Trip Romp

GETTY 103113 Gavel?  SQUARESPACE CACHEVERSION=1383209393828iStock/Thinkstock(LONDON) — An Australian woman who has waged a six-year battle to collect workers’ comp for an injury she suffered during sex on a business trip, has seen her hopes officially dashed.

Last year, Australia’s Federal Court decided the unidentified woman was eligible for worker’s compensation for the 2007 incident.  Her former employer had filed an appeal, saying her romp was her own business — and the injury from a falling lamp during the deed wasn’t their responsibility.

The Telegraph reports Australia’s highest court finally ruled in a 4-1 decision this week that the bureaucrat’s employer, ComCare, wasn’t ultimately responsible for the falling lamp, which injured her face and caused “psychological damage.” 

The court determined because the injury was caused, “not [by] an ordinary incident of an overnight stay like showering, sleeping, eating…” it was the fault of the injured.

Furthermore, because the woman or her partner actually yanked the hanging light from its fixture in the throes of passion — and it wasn’t felled by some kind of defect — the motel booked by her employer couldn’t be held responsible either.
