(BOISE, ID) – Democratic State Rep. John Gannon of Boise is challenging Idaho’s requirement for married same-sex couples to file state taxes as singles, even if the federal government recognizes their marriages. A federal judge recently required Ohio to allow same-sex couples legally married in other states to file their taxes as married in that state, even though there’s a ban on gay marriages in Ohio. Gannon says it opens up Idaho to several federal lawsuits once tax season rolls around. The Idaho Tax Commission maintains that the current law is in line with the state constitution.
