Hardy’s appeal was set to begin on Monday, but his ex-girlfriend Nicole Holder, was a no-show for the hearing.

“Without her testimony, in this particular instance, the State could not proceed,” the district attorney’s office said.

Hardy played just one game for the Panthers in 2014 after he was placed on the inactive roster. He was then placed on the commissioner’s exempt list before Week 3 until his case was resolved.

Despite appearing in just one game last season, the Panthers still paid Hardy $13.1 million after the team used the franchise tag on him during the 2013 offseason.

ESPN.com reports that the Panthers will not pursue Hardy as he is now set to hit the free agent market.

Had he been found guilty, Hardy would have been subject to a minimum six-week suspension by the NFL under the league’s new code of conduct policy.
