Tracy Morgan Still Struggling to Recover from Car Crash

ABC 060714 TracyMorgan?  SQUARESPACE CACHEVERSION=1416404640846ABC/Randy Holmes(TRENTON, N.J.) — Tracy Morgan is on the road to recovery, but he is still struggling, his lawyer said Tuesday.

“Mr. Morgan is a fighter,” attorney Benedict Morelli told reporters outside of federal court in Trenton, New Jersey. “He’s fighting to get better. If there’s a chance to be back to the Tracy Morgan he once was, he is going to try to do that. We just don’t know.”

Morgan suffered multiple broken bones and a traumatic brain injury when a Walmart truck slammed into his limo on the New Jersey Turnpike back in June. The crash killed comedian James “Jimmy Mack” McNair, and injured three other passengers.

Morgan, 45, is suing Walmart over the crash. He is accusing the retailer of being negligent when they put driver Kevin Roper behind the wheel. Roper, 35, had allegedly been awake for more than a full day before the crash. He has pleaded not guilty to vehicular homicide and four counts of assault by auto. In court documents, Walmart said the passengers were partly to blame because they weren’t wearing seat belts.

Attorneys for both Morgan and the retail chain were in court Tuesday to schedule dates in the civil case.
