Man who called police about naked woman in bed gets arrested with her on drug charges

IDAHO FALLS — A man and a woman are facing drug charges after the man allegedly called police to his apartment when he found a naked stranger in his bed. Police ultimately found illegal drugs scattered throughout the apartment.
According to an affidavit of probable cause filed by the Idaho Falls Police Department, on Sunday at 11:40 p.m., an officer was sent to an apartment for a trespassing call. Kelly Starnes, 34, had told police he woke up with a naked woman he did not know in his bed. He said he had no idea how she got into his apartment.
Police identified the woman as Leah Ball, 37, of Idaho Falls. Next to the bed was a white purse. Officers asked if it was hers, and she said yes. Police asked her if they could look in the purse, and she said, “I don’t care,” according to court documents.
Inside was a piece of tinfoil wrapped around the body of a partially melted plastic pen. There was burnt residue inside the foil. Officers believed it was consistent with paraphernalia used to ingest fentanyl.
Officers began to look around the home and found two pieces of folded aluminum foil on a table. When the foil was opened, each contained a blue circular pill. The pills were consistent with looking like illegally manufactured fentanyl pills commonly known as “dirty 30s,” documents said.
Officers found an upside-down soda can with a white crystalline substance in the bedroom. The substance was later tested to be presumptive positive for methamphetamine.
“Based on my training experience, I recognized the Pepsi can to be consistent in appearance to paraphernalia used to dissolve methamphetamine before injecting it into the user’s veins,” an officer wrote in court documents.
Next to the Pepsi can was a used syringe.
An officer asked Starnes about the items found inside his apartment. The officer said Ball appeared to be under the influence of illegal substances. Starnes still claimed he had no idea who she was and how she got there. Starnes appeared to be paranoid and fidgety, court documents said.
The officer told Starnes that multiple illegal substances and paraphernalia items were found in his apartment. Starnes said there should have been nothing inside his apartment and claimed he did not use drugs.
Officers asked him to show them his arms. When Starnes held out his arms, he said, “What the (expletive),” while looking down at his arms. He had evidence of an injection.
He allegedly said, “Dude, those weren’t there.”
Starnes was placed under arrest. Starnes has been charged with felony possession of a controlled substance and misdemeanor possession of drug paraphernalia. He is scheduled for a preliminary hearing on April 18 at 1 p.m. at the Bonneville County Courthouse.
As for Ball, she was transported to the hospital to be evaluated. She was cleared for jail and then placed under arrest. She’s been charged with felony possession of a controlled substance and misdemeanor possession of drug paraphernalia. She is scheduled for a preliminary hearing on April 19 at 1 p.m. at the Bonneville County Courthouse.
