LAVA HOT SPRINGS — Two men were arrested in Lava Hot Springs after allegedly threatening a third man with a machete, a baseball bat and a metal pipe.
Davin Mitchell Jensen, 27, has been charged with one count of aggravated assault and intimidating, impeding, influencing or preventing the attendance of a witness, both felonies.
Gabriel Michael Fultz Lindsey, 20, has been charged with one felony count of aggravated assault.
According to court documents, deputies from the Bannock County Sheriff’s Department responded to an address on North Center Street in Lava Hot Springs after the victim, Jensen’s ex-girlfriend’s father, reported a “kid” was threatening him with a baseball bat.
The victim told law enforcement that he had come to check on his daughter because he was concerned for her after a breakup. When the victim arrived, he saw Jensen, his daughter’s ex, and reportedly told him to “get the f*** out of” there, according to court documents.
Jensen and Lindsey reportedly left briefly but circled around afterward, at which point the victim reported he was afraid the two other men were going to jump him. The victim allegedly saw a pipe in Jensen’s hand, and Jensen kept telling the victim to “come into the shadows,” court documents allege. At this point, the victim said he called 911 and saw Lindsey brandish a machete.
The victim reported that Lindsey and Jensen allegedly put the weapons on the ground, but continued yelling threats at him as he spoke with dispatch.
Court documents state that deputies located Jensen and Lindsey walking toward a nearby apartment complex. When asked about the incident, Jensen allegedly told law enforcement that the victim was lying and had been the aggressor.
Jensen and Lindsey were both taken into custody, and they consented to a search of their vehicle, but after searching the vehicle and the area nearby, law enforcement was unable to locate the alleged weapons.
After Jensen and Lindsey were placed under arrest, deputies spoke with the victim again, who reported that Jensen had allegedly sent texts to the victim’s daughter. In one of the texts, Jensen allegedly said, “Your dad gonna end up in the f***ing hospital tonight f*** that,” and “Please don’t snitch to cops.”
If found guilty of the charges against him, Jensen may face up to 10 years’ confinement and may be required to pay fines of up to $55,000.
Lindsey may face up to five years’ confinement and may be required to pay fines of up to $5,000.
Both men have been appointed public defenders. The Idaho State Public Defender’s Office does not comment on active cases.
Jensen and Lindsey are both scheduled to appear in court on Oct. 15 for a preliminary hearing.
Although Jensen and Lindsey have been accused of crimes, that does not necessarily mean they committed them. Everyone is presumed innocent until proven guilty.
