Man accused of Tautphaus Park murder speaks from behind bars

IDAHO FALLS — The man accused of murdering 31-year-old Deraek Larson had his first court appearance Thursday afternoon.

Dressed in a green county-issued jumpsuit, 18-year-old Brian J. Mitchell of Shelley appeared calm as he spoke via video conference from a maximum security section of the Bonneville County jail.

Judge Jason Walker asked if Mitchell understood that he is being charged with second degree murder.

Mitchell calmly responded, “Yes, your honor.”

Walker asked if Mitchell was aware of his rights and the fact he could face between ten years to life in prison if found guilty.

Again, Mitchell replied, “Yes, your honor.”

Bonneville County prosecutor Danny Clark suggested Mitchell’s bond be set at $500,000.

“Given the nature of the offense, it is, in my mind, somewhat low but I will set bond at 500 thousand dollars cash,” Walker responded.

Mitchell admitted he was unemployed and requested a public defender to represent him.

None of Mitchell’s or Larson’s family or friends attended the arraignment. The only people in the courtroom were court personnel and members of the media.

A preliminary hearing regarding the murder charge was scheduled for Sept. 2.

Meanwhile, Mitchell also addressed an absconding probation charge he’s facing in juvenile court.

When asked about the charge, Mitchell said, “I admit to it.”

After Walker reviewed the consequences of pleading guilty, Mitchell changed his plea and Walker entered a denial on his behalf.

Mitchell will appear in court Aug. 25 on the probation charge.
