Man arrested after allegedly shooting multiple rounds outside of restaurant in Victor

VICTOR — A 34-year-old man was arrested after firing multiple shots at another man early Sunday morning.

Jose Luis Facio Garcia was charged with felony attempted aggravated assault, felony carrying a concealed weapon while under the influence of alcohol or drugs and misdemeanor discharging a firearm at another.

Facio Garcia faces three and a half years in prison if found guilty.

According to court documents, at around 2:30 a.m. on April 20, a Teton County Sheriff’s deputy notified a detective of a noise that sounded like gunshots.

The deputy was near Main Street and saw a black Jeep and a white Subaru leaving the parking lot of a Mexican restaurant around the 100 block of South Main Street.

The deputy spoke to witnesses near the restaurant who said the Jeep was involved, and four shell casings were found.

Teton County Sheriff Clint Lemieux and the detective found both vehicles and initiated a traffic stop on the Jeep.

Two individuals were questioned, but according to the document, the driver had changed her story.

The driver told Lemieux that she and her passenger had come from home but hadn’t gone anywhere. Later, she admitted that they had gone to the Mexican restaurant and saw the white car shoot in front of them before leaving.

The driver was placed under arrest after Lemieux searched the Jeep and found two open containers of beer.

Next, the passenger was spoken to, who said they were leaving the restaurant with Facio Garcia and another individual.

Facio Garcia and the other individual left in the Subaru, and the passenger said she saw Garcia stick a handgun out of the passenger window and fired several shots.

Lemieux located the Subaru in Driggs, a traffic stop was initiated, and its occupants were detained.

Facio Garcia was found in the passenger seat of the Subaru.

The document states both individuals were read their Miranda Rights, and it was reported that Facio Garcia was visibly under the influence of alcohol, unsteady on his feet, and had glassy and bloodshot eyes. The smell of alcohol was strong, emanating from Facio Garcia.

When questioned about the shooting, Facio Garcia and the driver denied knowing about the incident.

The driver later told Lemieux and the detective that he had given Facio Garcia a ride home and was unaware of his passenger’s plan to shoot, which caught him off guard.

When asked about the location of the gun, the driver said they hid it in the trunk of the Subaru under a bag. A Springfield XD handgun was found, which matched the .45 caliber shell casings that were found.

Facio Garcia was questioned, and he alleged a person had been threatening him over money that was owed.

The 34-year-old told the detective that the person had threatened him with a firearm two weeks ago at a Mexican market in Driggs. Facio Garcia said he bought the gun for protection.

When he was at the restaurant, he had placed the handgun in his waistband and saw the person outside parked near some vehicles.

As Facio Garcia was leaving, he said he saw the person’s car behind him, and that’s when he stuck his hand outside and fired multiple times.

When asked if he was intending to hit the person who allegedly threatened him, Facio Garcia said no, but that he wanted to scare them.

Facio Garcia is scheduled to appear before Magistrate Judge Jason Walker for a preliminary hearing at 1:30 p.m. on April 30.

Though Facio Garcia has been charged with these crimes, this does not necessarily mean he committed them. Everyone is presumed innocent until proven guilty.
