AMMON — An Ammon man will serve probation for pulling a gun and threatening to shoot someone.

Joseph David Vazquez, 37, was placed on a five-year term on probation Tuesday after he pleaded guilty to felony aggravated assault. District Judge Jon Shindurling suspended a two to seven-year prison sentence that could be served if Vazquez is not successful on probation.

As part of a plea agreement made with Bonneville County prosecutors, a misdemeanor charge of resisting arrest was dropped. Additionally, prosecutors agreed to recommend a two-year minimum prison sentence.

The Bonneville County Sheriff’s Office arrested Vazquez in December after being called to 400 South block of Falcon Drive. Deputies say Vazquez got into an argument with a group of people before pulling a handgun from his waistband and threatening to shoot one of those involved.

Vazquez went back into his apartment and deputies found a 9mm handgun with a loaded magazine in Vazquez’s bag. He admitted getting into an argument but claimed he only lifted his shirt to show a gun tucked in his waistband.

Court documents do not indicate what the argument was about.

In addition to probation, Vazquez’s court records show he was ordered to pay $1,245.50 in fees and fines.
