Trial delayed for Rexburg man facing 8 counts of wire fraud, aggravated identity theft

REXBURG — The federal trial for a Rexburg man facing eight felony charges of wire fraud and aggravated identity theft has been rescheduled for December.

Kelly McCandless was indicted in U.S. District Court in February on four counts of wire fraud and four counts of aggravated identity theft. He’s accused of defrauding his business partners out of hundreds of thousands of dollars.

A trial was scheduled to begin last week but Matthew Kinghorn, McCandless’s defense attorney, filed a motion to delay proceedings “on the grounds that defendant is continuing investigation in the facts of the case.”

“There is a voluminous amount of discovery documents in this case which has made it more time consuming to review and determine what additional information may be needed,” Kinghorn wrote.

The federal government did not object to the request and Chief U.S. District Court Judge David Nye granted the continuance.

The trial is now scheduled to begin Dec. 19 at the federal courthouse in Pocatello.

According to the criminal indictment, McCandless entered into an agreement with two business partners to develop an apartment complex in Rexburg. He’s accused of falsifying documents and using money from the project’s bank account for personal expenses.

McCandless has pleaded not guilty to all charges.
