Man involved in Pocatello shooting last December sentenced to prison

POCATELLO — A Pocatello man who pleaded guilty to shooting another man during an altercation last year has been sentenced to 10 years in prison.

Jeremiah Davis Cox, 40, pleaded guilty to aggravated battery and unlawful possession of a firearm by a convicted felon after reaching a plea agreement with the Bannock County Prosecutor’s Office, court records show. In exchange, two other counts of aggravated assault, one count of destruction of evidence, a persistent violator enhancement and a deadly weapon enhancement were all dismissed.

He was sentenced to a prison term of five to 10 years for the aggravated battery charge and five years for the possession charge, with the sentences to be served concurrently, by District Judge Robert Naftz.

The charges came after Pocatello police responded to reports of a shooting near Constitution Park on Dec. 2, 2022. They shut down multiple streets in the area to investigate the incident.

Two men were taken to Portneuf Medical Center for treatment. Cox was treated for stab wounds, then taken to the Pocatello Police Department for questioning.

The other man was treated for gunshot wounds. His identity was not released, nor were details regarding the wounds he suffered and his status following emergency treatment. However, police reports show seven spent 9mm shell casings were found at the scene.

A witness told officers that while they were taking Cox to the hospital, Cox saw the victim on the sidewalks and fired another round at him. Officers found an eighth spent shell casing inside the vehicle.

After he was questioned, Cox was arrested and later charged with aggravated battery, two counts of aggravated assault with a deadly weapon, unlawful possession of a firearm and destruction or concealment of evidence.

In addition to the prison sentence, Cox has been ordered to pay $491 in fees and fines.
