Prosecutors seek probation for Rexburg man accused of abusing girls

REXBURG — A plea agreement has been reached in the case of a man who allegedly sexually abused two young girls.
Garon C. Miskin is expected to plead guilty on March 20, to two charges of felony injury to children. He faces a maximum of 10 years in prison and a $10,000 fine. Per the plea agreement, the prosecution will recommend probation.
Two charges of felony lewd conduct with a minor under 16 will be dismissed as part of the agreement. His misdemeanor charge of resisting arrest will also be dismissed by the prosecution.
“We reached this agreement based on admissible evidence and the risks of going to trial,” Bonneville County Prosecuting Attorney Danny Clark told EastIdahoNews.com.
It is likely more details about the plea agreement will be made available after Miskin pleads guilty on March 20. The agreement is non-binding, meaning the judge is not bound by the agreement or any sentencing recommendations, and may impose any sentence authorized by law.
Bonneville County is prosecuting Miskin because of a conflict of interest between Miskin and the Madison County Prosecutor’s Office.
According to court records, two female victims reported the sexual abuse to the Family Crisis Center in Rexburg. The abuse had occurred several years before.
One victim said the abuse started when she was 6 years old and continued until she was 8 years old, according to court documents. The other child said the abuse happened between the time she was between 10 and 14 years old.
Court records show Miskin is related to the victims.
Both victims told investigators that Miskin touched them under their clothing, on their chest and groin area several times.
One victim disclosed to investigators that at a young age, Miskin dressed her in a “revealing” dress and took photos of her and pictures under her dress.
Miskin also used a video camera to watch the girl undress through her bedroom window, according to court documents.
