Man gets jail time and probation for threatening neighbors with baseball bat

IDAHO FALLS — An Idaho Falls man will receive jail time for threatening his neighbors with a baseball bat in June.

District Judge Joel Tingey sentenced Jose N Sarahut-izucar, 24, to 30 days in jail and four years of felony probation. Tingey opted to suspend an underlying two- to six-year prison sentence, which Sarahut-izucar could be ordered to serve if he’s not successful on probation.

In March, Sarahut-izucar pleaded guilty to felony aggravated assault with a deadly weapon as part of a plea agreement that stipulated prosecutors would recommend he spend time on probation.

Sarahut-izucar’s legal troubles began after he threatened a half-a-dozen neighbors on the 700 block of North Stevens Drive in Idaho Falls. A woman called the Bonneville County Sheriff’s Office after Sarahut-izucar was driving recklessly in the neighborhood, according to charging documents.

One of the neighbors yelled at Sarahut-izucar to slow down. The neighbor later told police that Sarahut-izucar came aggressively toward him with the baseball bat yelling, “Get some!” according to court documents. As more neighbors arrived at the disturbance, Sarahut-izucar allegedly lifted the bat over his head, attempting to strike bystanders.

According to witnesses, Sarahut-izucar got into his Chevy Tahoe and reversed toward the group standing in the street and the sidewalk. The Tahoe struck a parked car before Sarahut-izucar drove away.

One neighbor showed deputies a video as part of the incident that shows Sarahut-izucar aggressively wielding limb shears, according to the probable cause. Then the video shows Sarahut-izucar go back to the Tahoe, where he puts the shears away and grabs the baseball bat. As Sarahut-izucar approaches the men, the video stops.

In addition to the time on probation, Tingey ordered Sarahut-izucar to pay $1,055.50 in fees and fines.
