Pocatello woman gets time served, probation for injuring an infant

POCATELLO — A woman who birthed a baby addicted to opiates and suffering from “significant withdrawals” has been sentenced to probation.

Lydia Anna Hernandez, 33, was sentenced to 90 days in jail by Magistrate Judge Carol Tippi Jarman for a misdemeanor charge of injury to a child, court records show. However, Hernandez received 30 days credit for times served, and the other 60 days were suspended. She had been placed on probation for one year.

Hernandez was arrested in August following a months-long investigation by Pocatello police. That investigation was triggered by a call from the Idaho Department of Health and Welfare, which was contacted by Portneuf Medical Center.

According to the police investigation, Hernandez gave birth in April to a baby suffering from what doctors called “significant withdrawal symptoms.” The baby was treated with opiate micro-doses to combat the withdrawals and was eventually discharged from the hospital into the care of a family member.

Hernandez reached a plea agreement with the Bannock County Prosecutor’s Office that saw her plead guilty to an amended charge — from felony injury to a child to misdemeanor.

In addition to probation, Hernandez has been ordered to pay $232.50 in fees and fines.
